Individual Unemployability (TDIU): Who Actually Qualifies

TDIU is not a separate rating. It is a determination that your service-connected conditions, whatever their schedular percentages, make it impossible to hold substantially gainful employment. Compensation is then paid at the 100 percent rate.

The practical significance is that the rating schedule measures average impairment across a population. TDIU exists because the average does not always describe an individual. A condition rated at 60 percent on paper may end a specific career entirely.

There is a schedular path with specific rating thresholds, generally involving either one condition at a certain percentage or a combined rating at a certain percentage with at least one condition meeting a minimum. There is also an extraschedular path for veterans who do not meet those thresholds but whose situation clearly warrants consideration.

The extraschedular route is less known and less used. It exists precisely for cases where the numbers do not capture reality, and it requires a case to be made rather than a box to be checked.

The standard is not total inability to do anything. It is inability to maintain substantially gainful employment, which is generally understood in relation to the federal poverty threshold and excludes what is termed marginal employment.

Sheltered employment, such as work in a protected environment or a family business making significant accommodations, may also not count against you. Veterans regularly assume that any work at all disqualifies them, and that assumption keeps eligible people from applying.

The strongest TDIU cases connect the medical condition to the specific work limitation. A medical opinion stating that a condition prevents the physical or cognitive demands of your occupation does more than a general severity statement.

Employment history supports this: reduced hours, accommodations that were made, jobs lost or left because of symptoms, and statements from former employers. Vocational expert opinions are used in stronger cases and can be decisive where the connection is contested.

TDIU awards are subject to review, and returning to substantially gainful employment can affect the benefit, so understanding the reporting expectations matters. Ratings held for long periods also gain certain protections, which is a factor worth understanding in advance.

This is a benefit where an accredited representative makes a genuine difference. The eligibility rules, the extraschedular path, and the employability evidence standard are all areas where framing determines outcome.
